Premises Liability Lawsuit Against Extended-Stay Motel Results in $3.2 Million Settlement
A serious premises liability lawsuit was brought on behalf of a woman who suffered catastrophic spinal injuries while staying at an extended-stay motel. During her tenancy, the guest repeatedly encountered a dangerously warped and deteriorated entry door to her room. The door routinely became stuck when closed, requiring significant force to open from the inside.
According to the lawsuit, the guest made multiple complaints to motel management regarding the defective door and the unsafe condition of the entryway. Despite repeated notice of the hazard, the door was never properly repaired or replaced.
One day, while attempting to leave her room, the guest forcefully pulled on the door handle as she had been forced to do on prior occasions. Without warning, the handle detached completely from the door, causing her to fall violently backward onto the floor.
As a result of the fall, she sustained devastating injuries, including a burst fracture to her lumbar spine, severe neck trauma, and permanent spinal cord damage. The injuries ultimately led to partial paralysis and long-term physical impairment.
Our legal team pursued claims based on negligent property maintenance, unsafe premises conditions, and failure to repair a known hazard despite repeated complaints from the tenant. The case ultimately resolved through a substantial settlement.
Gross settlement: $3,200,000. Attorney’s Fees: $1,440,000. Case Expenses: $182,351.96. Net to client: $1,399,135.51
