Herbal Supplement Wrongful Death Lawsuit Results in $1.5 Million Settlement
This herbal supplement wrongful death lawsuit involved the tragic death of a man after he and his partner consumed a liquid product marketed as an “herbal supplement” intended to enhance intimacy. The products liability lawsuit alleged that the manufacturer distributed a dangerous and inadequately tested substance without proper safety oversight, warnings, or quality control procedures.
The couple purchased the liquid aphrodisiac believing it to be a safe herbal supplement available for consumer use. Shortly after consuming the product, both individuals lost consciousness. The woman later regained consciousness, but her partner did not survive.
Because the product was marketed as an herbal supplement, it was not subject to the same level of federal review and approval typically associated with pharmaceutical drugs regulated by the U.S. Food and Drug Administration (FDA). During the investigation, our legal team traced the manufacturer to a warehouse operation in Arizona where the product was being mixed and distributed by individuals with no formal background in chemistry, toxicology, or pharmaceuticals.
Through discovery, evidence revealed that the company maintained inadequate manufacturing records and could not definitively identify all ingredients contained within the product. The investigation ultimately uncovered the presence of butanediol, a chemical compound associated with severe health risks including respiratory depression, loss of consciousness, and death.
The lawsuit alleged negligent manufacturing practices, dangerous product design, failure to warn consumers, and inadequate testing of the supplement before distribution to the public. The matter ultimately resolved through settlement.
Gross settlement: $1,500,000. Attorney’s Fees: $600,000. Case Expenses: $38,657.88. Net to client: $861,342,12.
